Justice Rares has referred the conduct of Mr Shanks and Google to the court’s principal registrar to consider proceedings against each for “what appear to be serious contempts of court by bringing improper pressure to bear on Mr Barilaro and his lawyers not to pursue this proceeding”. “In my opinion, it is necessary to award a substantial sum in damages to compensate Mr Barilaro for the harm that Google caused to him and to vindicate his reputation.” Mr Shanks repeatedly and vindictively used descriptions of him such as “wog”, “greasy”, “greasy little scrotum”, “meatball” and innuendos linking him to the Italian mafia.

Both videos are still up on YouTube with minor edits following Shanks-Markovina’s settlement. Jordan Shanks, aka friendlyjordies, is an Australian YouTuber and comedian whose content focuses heavily on political commentary. Google is an American multinational tech company that owns YouTube, a video-sharing and social media platform with more than 2.6 billion active users worldwide.

Mr Shanks, who Justice Rares said “needed YouTube to disseminate his poison”, edited the videos, apologised and paid $100,000 to Mr Barilaro’s costs of his unsuccessful applications for a stay of the proceeding and a jury trial. The justice said Mr Barilaro gave evidence, which he accepted, that every imputation made was false and he found the former MP had been “traumatised” by the videos. In 2021, Mr Shanks and Mr Barilaro agreed to settle the issues in the proceeding between them.
