“After that she pulled me in passionately and kissed me. The women also consumed cocaine in a toilet block. During a summing up the Crown and defence cases before the jury retired to consider its verdict, Judge Townsend said the woman had previously told the court she was “deliberately dishonest” to Mr Sailor and had sent “leading” messages to him on Instagram which referred to him as honey and baby despite her maintaining in court she was not attracted to him. Sailor and Mr Blacker told the court the woman, who had consumed about 11 standard drinks, did not appear to be overly intoxicated in the bedroom and she was “definitely conscious”. The court was told the woman was not a regular drinker and before arriving at the pub she and the friend Mr Blacker knew had been at a Mexican restaurant enjoying an all-you-can-eat and drink margaritas and tacos event. During the trial the court was told the woman and Sailor met on the social networking app Instagram in 2019 when he was on the cusp of following in his father’s footsteps and making his NRL debut for the St George Illawarra Dragons.

The former NRL footballer had faced trial in the NSW District Court accused of assaulting a woman who was too drunk to consent in October 2020.

Mr Sailor told the jury the woman did not appear to be intoxicated and remained conscious and alert throughout their sexual encounter, during which she gave her consent multiple times. A friend told the court she discovered the woman naked on the floor shortly after Mr Sailor left her bedroom the night before. The woman told the court her last memory before she blacked out was sitting at her kitchen table and playing a drinking game while feeling “wobbly” and experiencing head spins.

Former NRL player Tristan Sailor has been found not guilty of raping a woman who says she was so drunk she woke up naked with no memory as to what happened.

Mr Pontello argued she was clearly attracted to Sailor, pointing to her interactions with him at a venue earlier on the evening. Her friend gave evidence that after the two men left the apartment she found the woman in her room unresponsive making "grunting noises" with her eyes open, and lifted her onto the bed when she began to vomit. Sailor was accused of having sex with the woman while she was either unconscious or too intoxicated to consent after a night out in Sydney with friends in October 2020.

The next day, she sent Mr Sailor messages asking "what happened last night?" He said the woman as "not very" intoxicated at the time and just seemed "happy" and "chatty". He gave evidence he asked her if she was "sweet" to which she replied "yes" and then soon after asked if she was "sure" she wanted to have sex and "wasn't talking to anyone".

Former NRL player Tristan Sailor has been found not guilty of raping a woman who says she was so drunk she woke up naked with no memory as to what happened.

Mr Pontello argued she was clearly attracted to Sailor, pointing to her interactions with him at a venue earlier on the evening. Her friend gave evidence that after the two men left the apartment she found the woman in her room unresponsive making "grunting noises" with her eyes open, and lifted her onto the bed when she began to vomit. But in summing up his case on Wednesday, Mr Pontello urged the jury to reject the complainant's evidence, saying she was uncooperative and less than forthcoming. The Crown prosecutor on Tuesday unsuccessfully argued that the jury should disregard Sailor's evidence, saying it was "fundamentally at odds" with other evidence in the trial. In evidence the woman denied harbouring any sexual attraction to Sailor and in those messages deliberately dishonestly led him on because she "didn't want to be rude". Asked about her affections towards Sailor at the hotel prior, the woman responded: "That's because I was very drunk." Sailor was accused of having sex with the woman while she was either unconscious or too intoxicated to consent after a night out in Sydney with friends in October 2020.
